Leticia LOPEZ, Appellant v. The STATE of Texas, Appellee

From the 187th Judicial District Court, Bexar County, Texas Trial Court No. 2019CR5852W Honorable Raymond Angelini, Judge Presiding

Beth Watkins, Justice Liza A. Rodriguez, Justice Sandee Bryan Marion, Chief Justice (Ret.)

Sitting by assignment pursuant to section 74.003(b) of the Texas Government Code.

ORDER

PER CURIAM

In reviewing a supplemental clerk's record filed in this court on March 8, 2023, it came to this court's attention that on March 7, 2023, Appellant Leticia Lopez filed a pro se Motion to Dismiss Appeal in the trial court. The motion does not comply with Texas Rule of Appellate Procedure 42.2 in that it is not signed by her attorney. See Tex. R. App. P. 42.2 ("The appellant and his or her attorney must sign the written motion to dismiss and file it in duplicate with the appellate clerk, who must immediately send the duplicate copy to the trial court clerk.") (emphasis added).

We ORDER Lopez's appointed appellate counsel, Abasi Major, to confer with his client and determine whether Lopez desires to proceed with this appeal or whether she desires to file a motion to dismiss in conformity with Texas Rule of Appellate Procedure 42.2. We ORDER Abasi Major to file a written response indicating his client's intent on or before July 21, 2023.

It is so ORDERED.
