The clerk's record and the reporter's record in this case are overdue. The records were originally due December 27, 2022.
On December 29, 2022, this Court notified the Dallas County District Clerk that the clerk's record was overdue and directed the Dallas County District Clerk to file the clerk's record within thirty days, that is, by January 30, 2023, because January 28, 2023 was a Saturday. See Tex. R. App. P. 4.1(a). However, as of the date of this order, the clerk's record has not been filed. Accordingly, we ORDER Felicia Pitre, Dallas County District Clerk, to file the clerk's record for this appeal with this Court no later than MARCH 10, 2023.
On December 28, 2022, Yolanda Atkins, Court Reporter, requested an extension of thirty days to file the reporter's record. On December 30, 2022, we granted the request and ordered the reporter's record was due January 27, 2023. As of the date of this order, the reporter's record has not been filed, and Ms. Atkins has not communicated further with this Court concerning this appeal.
We ORDER Yolanda Atkins, Court Reporter, to file the reporter's record with this Court by MARCH 10, 2023. If the reporter's record is not filed by March 10, 2023, we may order the trial court to hold a hearing and determine why the reporter's record has not been filed.
The Clerk is DIRECTED to send copies of this order to Felicia Pitre, Dallas County District Clerk; Yolanda Atkins, Court Reporter; and to counsel for all parties.
