Defendant/third-party plaintiff/second third-party plaintiff-appellant, GP Castle Realty, LLC, having moved for a stay of trial pending hearing and determination of the appeal taken from the order of the Supreme Court, Bronx County, entered on or about April 16, 2019, which granted second third-party defendant-respondent Alsaedi's motion to dismiss the second third-party action, and denied GP Castle Realty, LLC's motion for summary judgment as against Alsaedi for contractual indemnification, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied and the interim relief granted by an order of a Justice of this Court, dated August 29, 2019, is hereby vacated.
