Motion by the respondent on an appeal from an order of the Supreme Court, Queens County, dated November 12, 1998, inter alia, to strike the appellants' record and brief on the ground, among other things, that they contain or refer to matter dehors the record. By decision and order on motion dated June 28, 19 99, the branch of the motion which was to strike the appellants' record and brief on appeal was held in abeyance and referred to the Justices hearing the appeal for determination upon the argument or submission thereof.


DECISION ORDER ON MOTION

Upon the papers filed in support of the motion, the papers filed in opposition thereto, and the argument of the appeal, it is

ORDERED that the branch of the motion which is to strike the record on appeal is granted to the extent that pages 205-21, 223-51, 264-79, 2 82-88, 291-96, 314, 356-58, 360-61, 375-89, 392-93, and 396-401 of the appellants' record on appeal, and all references thereto contained in the appellants' brief, are stricken and have not been considered on the appeal; and it is further,

ORDERED that the branch of the motion is otherwise denied.
