DISMISSAL OF ACTION/STIPULATION AND ORDER


Pursuant to Rule 41 of the Federal Rules of Civil Procedure, the parties stipulate to dismissal of this action, each party to bear own costs.

It is further stipulated that this dismissal is not to be construed as having any effect on other litigation Fletcher Hyler has pending per the Appeal to the 9th Circuit, Hyler v. CIR, No. 03-71277; a District Court case, Hyler v. United States, DK No. 02-2778 N.D.C.A., dismissed without prejudice to reinstate pending the decision in the aforesaid 9th Circuit case, and a District Court case, Hyler v. United States, DK No. 03-02081 N.D.C.A. pending.

ORDER

Pursuant to the above stipulation of the parties above stated, IT IS ORDERED that this case be dismissed.
