EDWARD LIVINGSTON, Appellant v. DENISE TRIONE, Appellee

On Appeal from the 9th District Court

Montgomery County, Texas

Trial Cause No. 11-05-05395 CV

MEMORANDUM OPINION

Edward Livingston filed a notice of appeal from an order granting leave to withdraw deemed admissions. We questioned our jurisdiction over the appeal. In his response, the appellant concedes that the order is not appealable at this time. We also note the attempted appeal is from an interlocutory order. Accordingly, we dismiss the appeal for lack of jurisdiction.

APPEAL DISMISSED.
