ORDER GRANTING SUMMARY JUDGMENT ON PLAINTIFF'S REMAINING CLAIM
On January 28, 2004, the Court, having previously granted summary judgment in favor of defendant City and County of San Francisco ("City") on all but plaintiff's Monell claim, granted summary judgment in favor of defendant Kevin Quinn on all claims and ordered plaintiff to show cause in writing why summary judgment should not be granted in favor of defendant City on plaintiff's remaining Monell claim.
Thereafter, on February 17, 2004, plaintiff filed his response to the Court's order to show cause, in which plaintiff states he "does not object to the Court's entering judgment against plaintiff on the Monell cause of action," which, as plaintiff acknowledges, "will result in dismissal of this action in its entirety."
Accordingly, the Court hereby GRANTS summary judgment in favor of defendant City on plaintiff's remaining Monell claim.
The Clerk shall close the file.
