This case is calendared for trial at the Court's February 13, 2023, Atlanta, Georgia, Trial Session.
On January 10, 2023, docket entry 29, respondent filed a Motion for Continuance of Trial which requests that the Court remove this case from the Trial Session of the Court scheduled to commence on February 13, 2023, at Atlanta, Georgia. The Motion indicates that the parties have reached a basis for settlement of this matter without the need to proceed to trial. Additionally, respondent is continuing to prepare computations and decision documents for review by petitioner. Respondent's motion also indicates that it is unknown whether petitioner objects to the granting of this motion, but respondent's Motion did not include a Certificate of Service.
The Court spoke with petitioner informally and petitioner indicated to the Court that there is no objection to respondent's Motion for Continuance.
The Court will therefore grant respondent's Motion for Continuance of Trial and restore the case to the general trial docket.
After due consideration, it is
ORDERED that, on or before January 31, 2023, respondent shall file a Certificate of Service with respect to just-referenced Motion for Continuance of Trial, filed January 10, 2023, docket entry 29, indicating that service of such has been made on petitioner. It is further
ORDERED that respondent's Motion for Continuance of Trial, filed January 10, 2023, docket entry 29, is granted in that this case is stricken for trial from the February 13, 2023, Atlanta, Georgia Trial Session and continued generally.
