We REINSTATE this appeal.

Before us is appellant's February 12, 2024 request for an extension of time to file his brief. We GRANT appellant's motion and ORDER appellant's brief filed on or before FEBRUARY 26, 2024. We set aside our January 7, 2024 order, directing the trial court to conduct a hearing on the record to determine why appellant's brief has not been filed.

If appellant's brief is not filed by that date, this appeal will be abated for the trial court to make findings in accordance with rule of appellate procedure 38.8. See Tex. R. App. P. 38.8(b)(2).

We DIRECT the Clerk to send copies of this order to the Honorable Andrea Thompson, Presiding Judge, 416th Judicial District Court, and counsel for all parties.
