AUTOMOBILES AND MOTOR VEHICLES, § 47.1payment of filling station rental, insufficiency of evidence to show. In action against lessor of filling station for rent paid by plantiff, who was not given possession of the premises, evidence showed that plaintiff did not pay the money as rent, but loaned the money to lessee corporation to pay the rent and took certain stock as collateral, and lessor did not purport to be renting premises to plaintiff.

Appeal from Municipal Court of Chicago; Hon. FRANK DONOGHUE, presiding.

Judgment reversed and judgment here for defendant and against plaintiff for costs. Heard in third division, first district, this court at December term, 1939.
