ORDER DISMISSING ACTION


On June 21, 2002, the Court conducted a status conference to determine the most efficient manner in which to proceed with this action. The government filed a motion to dismiss, pursuant to Fed.R.Civ.P. 12(b)(6), on June 21, 2002, and the plaintiff's attorney indicated that he would research the issue and file a response. On December 4, 2002, Plaintiff's attorney informed the Court that plaintiff does not oppose the government's motion to dismiss. Accordingly, the United States' Motion to Dismiss is GRANTED, and this action is DISMISSED.

It is so ORDERED.

The Clerk is directed to send copies of this order to counsel of record.
