By order of March 27, 2001, the application for leave to appeal from the July 30, 1999, decision of the Court of Appeals was held in abeyance pending the decision in Lugo v Ameritech Corp (Docket No. 112575). On order of the Court, the decision having been issued on July 3, 2001, 464 Mich. 512 (2001), the application is again considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for reconsideration in light of Lugo vAmeritech Corp.

Kelly, J., would deny leave to appeal.
