Appellant's briefs in these appeals were originally due December 1, 2022. On December 5, 2022, appellant moved for an extension of time to file the brief in cause number 05-22-00935-CR; we granted the motion and ordered appellant to file the brief by December 31, 2022. On January 3, 2023, appellant filed a motion for extension of time to file the brief in cause number 05-22-00935-CR; we granted the motion and ordered appellant to file the brief by January 31, 2023. On January 31, 2023, appellant filed the brief in cause number 05-22-00935-CR. The brief does not list cause number 05-22-00936-CR on the cover, and the arguments in the brief do not appear to apply to cause number 05-22-00936-CR.
No brief or motion for extension of time to file the brief has been filed in cause number 05-22-00936-CR, trial court cause number 33842CR. Appellant's appointed attorney, Peter Morgan, filed the notice of appeal in cause number 05-22-00936-CR, and he is the attorney of record in this appeal. Accordingly, we ORDER appellant's appointed attorney, Peter Morgan, to file appellant's brief in cause number 05-22-00936-CR and a motion for extension of time to file the brief in that cause number on or before FEBRUARY 17, 2023.
If appellant's brief in cause number 05-22-00936-CR and a motion for extension of time to file the brief are not filed by February 17, 2023, the Court may abate this case for a hearing in the trial court to determine why the brief has not been filed. See Tex. R. App. P. 38.8(b).
We DIRECT the Clerk to send copies of this order to appointed counsel for appellant, Peter Morgan, and to the Hunt County District Attorney's Office, Appellate Division.
