No. 6-082 / 05-0754

Filed March 1, 2006

Appeal from the Iowa District Court for Jones County, Denver D. Dillard, Judge.

Plaintiff appeals the district court's ruling granting defendant's motion for summary judgment. AFFIRMED.

Stephen C. Leonard, Fort Madison, pro se.

Thomas J. Miller, Attorney General, and William A. Hill, Assistant Attorney General, for appellee.

Considered by Sackett, C.J., and Vogel and Mahan, JJ.

Stephen Leonard, a former inmate at the Anamosa State Penitentiary, appeals the district court's ruling granting defendant's motion for summary judgment in his action claiming a constitutional violation based upon a retaliatory transfer. We have carefully reviewed Leonard's claims and the standard regarding retaliatory transfer set out in Rouse v. Benson, 193 F.3d 936, 940 (8th Cir. 1999). As a result, we conclude we can affirm the district court's ruling without further opinion. Iowa R. App. P. 6.24(1), (4).

AFFIRMED.
