The order dated January 23, 2004, allowing the motion for a new trial is affirmed. The judgment on Count IV of the complaint is reversed, and judgment shall enter for Hingham Mutual Fire Insurance Company. The judgment on Count III is vacated, and the matter is remanded for further proceedings consistent with the memorandum and order of the Appeals Court.
