Before the Court is Appellant's August 6, 2023 second motion to extend time to file his brief and contemporaneously tendered brief. Appellant's brief was due in this Court on Saturday August 5, 2023. Appellant filed his brief on August 6, 2023. Accordingly, Appellant's brief was timely filed. See Tex. R. App. P. 9.2 (c)(4)(A) (reciting that a document transmitted on a Saturday, Sunday, or legal holiday, is deemed filed on the next day that is not a Saturday, Sunday, or legal holiday). Because the brief was timely filed, Appellant's motion for extension of time to file the brief is DENIED as moot.
