MOTION DECISION

DECISION AND ORDER ON MOTION

Motion for preliminary injunction and preference.

Upon the papers filed in support of the motion and the papers filed in opposition to the motion for a preliminary injunction, it is

ORDERED that the motion for a preliminary injunction is granted, without costs, to the extent that respondents are enjoined from taking any action to place a parent and/or child in a host family home pursuant to the Host Family Home Program (18 NYCRR 444.1 et seq.) pending determination of the appeal, and it is further

ORDERED that the motion for a preference is granted, without costs, and the appeal is set down for the May 2023 term of this Court. The record on appeal and appellants' brief shall be filed and served on or before March 6, 2023. The respondents' brief shall be filed and served on or before April 6, 2023. The reply brief, if any, shall be filed and served on or before April 13, 2023.
