This Petition for Review from the October 26, 1989 Finding and Award of the Commissioner for the Eighth District was heard September 28, 1990 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners Frank Verrilli and George Waldron.


OPINION


Respondent appealed the October 26, 1989 Finding and Award of the Eighth District. While it has filed various Motions for Extension of Time to File; a Motion to Correct and Reasons of Appeal, no other documents were filed by the respondent in pursuit of its appeal.

The appeal was calendared to be heard by this Division September 28, 1990. No brief was filed by the respondent-appellant. Respondent did not appear at oral argument although counsel for respondent agreed that the Compensation Review Division should decide the instant appeal on the basis of papers submitted. We therefore dismiss the instant appeal as the respondent-appellant has failed to prosecute the appeal with due diligence. See Prac. Book Sec. 4055. See also, Coco v. Dunham-Bush, Inc., 4 Conn. Workers' Comp. Rev. Op. 48, 415 CRD-1-85 (1987).
