STIPULATION REGARDING DISMISSAL AND ORDER Fed.R. Civ p. 41(a)(1)(ii)


Pursuant to Federal Rule of Civil Procedure 41(a)(1)(ii), Plaintiff DONALD R. LASSMAN and Defendant THE SUTTA COMPANY, INC, by and through their undersigned counsel of record, stipulate as follows:

1. Plaintiff agrees to and hereby dismisses with prejudice all claims against Defendant;

2. In reliance upon the agreements in this Stipulation, Defendant agrees to waive any right to seek coats against Plaintiff;

3. The respective attorney by their signatures below, represent and warrant that they have the consent of their respective clients, have discussed this Stipulation with them and have the authority to bind their respective clients; and

4. This Stipulation may be executed in counterparts, and facsimile signatures shall be deemed original signatures.
