Appeal by plaintiff from an order of the Supreme Court, Rockland County, entered March 28, 1969, which granted defendants' motion to dismiss the action for failure to prosecute. Order reversed, without costs, and motion denied (see Patricia Ann Homes, Inc. v. Damiani, 35 A.D.2d 825, decided herewith; and stipulation of the parties dated "August 1970" that that decision shall govern the decision on this appeal).
