On order of the Court, the motion to tax costs and assess attorney fees is considered, and it is GRANTED in part. The Court directs the Clerk of this Court to, within 14 days of this order, tax ordinary costs pursuant to MCR 7.318 and MCR 7.219. The request to assess attorney fees is DENIED, because the Court is not persuaded that defendant's appeal to this Court was a vexatious proceeding.
