On order of the Court, the delayed application for leave to appeal from the August 21, 1998 decision of the Court of Appeals is considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would remand this case to the Court of Appeals to explain why it did not remand the case to the trial court for trial on the admitted disputed issues of fact.
