ORDER DISMISSING ACTION WITHOUT PREJUDICE
On August 2, 2004, the Court denied plaintiff Zakariah LaFreniere's ("LaFreniere") application to proceed in forma pauperis in the above-titled action, and ordered him to pay the appropriate filing fee no later than August 20, 2004. The Court further ordered that failure to pay the filing fee by that date would result in dismissal of the action without prejudice. To date, LaFreniere has not paid the filing fee.
Accordingly, the above-titled action is hereby DISMISSED, without prejudice.
The Clerk shall close the file.
