Appeal from Superior Court, Alameda County; John J. Allen, Judge.

Action by S. Kulawitz against the Pacific Woodenware & Paper Company seeking rescission of a lease, wherein defendant filed an answer and cross-complaint seeking to recover rental and counsel fees. From those portions of the judgment determining that lease had been terminated on a certain date and denying to defendant the recovery of rent accruing after that date and denying counsel fees in excess of a certain amount, defendant appeals.

Portions of judgment appealed from reversed.
