APPEAL AND ERROR, § 1855affirmance for lack of record. Where the court overruled objections to a report of a successor trustee and allowed fees to him and his attorney, and an appeal questioned the allowance of fees, and appellant having filed no report of proceedings and the order appealed from having recited that the court was "fully advised in the premises," there was nothing in the record to show an abuse by the court in the allowance of fees, which was discretionary with the court.

Appeal from Circuit Court of Cook county; Hon. ROBERT JEROME DUNNE, presiding.

Affirmed. Heard in third division, first district, this court at October term, 1941.
