Kostyshyn v. State

Supreme Court of Delaware
Dec 17, 2010

Opinion

No. 733, 2010.

December 17, 2010.

Court Below — Superior Court of the State of Delaware, in and for New Castle County, Cr. ID 0908020496.

ORDER

This 17th day of December 2010, it appears to the Court that, on November 29, 2010, the Clerk issued a notice to appellant to show cause why his appeal should not be dismissed for the Court's lack of jurisdiction to hear an interlocutory appeal in a criminal case. The appellant has failed to respond to the notice to show cause within the required ten-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.
