MEMORANDUM OPINION


Michael Kolander filed his appeal against First State Bank of Rio Vista on August 17, 2004. By letter, the Clerk advised Kolander that a $125 filing fee was due within ten days from the date of the letter to prevent dismissal of the appeal. More than ten days have passed and the filing fee has not been paid.

This appeal is dismissed. TEX. R. APP. P. 42.3(c).

Kolander's motion to dismiss is dismissed as moot.
