Present — Peck, P.J., Glennon, Callahan, Van Voorhis and Shientag, JJ.


Under the circumstances in this case and in view of the nature of the demand the order, so far as appealed from, is unanimously modified by directing the plaintiff to serve a verified bill of particulars before his examination before trial of the defendants and, as so modified, affirmed, with $20 costs and disbursements to the appellants. No opinion.
