Not final until disposition of timely filed motion for rehearing. Lower Tribunal No. 09-63-M An Appeal from the Circuit Court for Monroe County, Timothy J. Koenig, Judge. Donna Brown Klinka, in proper person. Stokes McMillan Antúnez, P.A., and Juan C. Antúnez; Kula & Associates, P.A., and Elliot B. Kula, W. Aaron Daniel and William D. Mueller, for appellee. Before LAGOA, EMAS and SCALES, JJ. PER CURIAM.
Affirmed. Applegate v. Barnett Bank of Tallahassee, 377 So. 2d 1150, 1152 (Fla. 1979) (holding that, given the presumption of correctness of the trial court's ruling, where no transcript is provided to appellate court, then appellate court is unable to conclude that the trial court abused its discretion).
