IN THE INTEREST OF K.L. AND C.L., Appellant v. TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES, Appellee

On Appeal from the 315th District Court Harris County, Texas Trial Court Cause No. 2020-01646J

Panel Consists of Chief Justice Christopher and Justices Wise and Hassan.

ORDER

PER CURIAM

No reporter's record has been filed in this case. The official court reporter for the 315th District Court informed this court that appellant had not requested the reporter's record be prepared or paid or made arrangements for payment for the reporter's record. On August 17, 2022, the clerk of this court notified appellant that we would consider and decide those issues that do not require a reporter's record unless appellant, within 15 days of notice, provided this court with proof of payment for the record. See Tex. R. App. P. 37.3(c). On September 13, 2022, appellant filed a letter stating the reporter's record was requested and paid for on September 1, 2022. Appellant provided no proof of the request or payment. On September 14, 2022, appellant was ordered to provide this court with proof of the request as well as payment or indigency by September 19, 2022, or we may consider and decide those issues or points that do not require a reporter's record. See Tex. App. P.37.3(c). No response was filed.

Accordingly, we order appellant's appointed counsel, Daniella Gonzalez, to file a brief in this appeal on or before October 10, 2022. If the brief is not filed by that date, counsel may be required to show cause why counsel should not be held in contempt of court. In addition, the court may require appointment of new counsel due to the failure to timely file appellant's brief.
