Opinion Filed November 23, 2009. DO NOT PUBLISH. Tex. R. App. P. 47

On Appeal from the Criminal District Court No. 2, Dallas County, Texas, Trial Court Cause No. F07-51302-I.

Before Justices MOSELEY, RICHTER, and FRANCIS.

MEMORANDUM OPINION

Roy Louis Kirk, Jr. was convicted of burglary of a habitation. Punishment was assessed at four years' imprisonment and a $1000 fine. Based on the trial court's findings regarding why the reporter's record has not been filed, we concluded that appellant, who is representing himself in this appeal and is on an appeal bond, has abandoned his appeal. We ordered the appeal submitted without the reporter's record and briefs. See Tex. R. App. P. 37.3(c), 38.8(b). Absent briefs, no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
