MEMORANDUM OPINION


Plaintiffs Daniel Kirk and Linda Kirk (the "Kirks"), pro se, have moved under Rule 37, Fed.R.Civ.P., to compel discovery and documents from defendant Joseph M. Heppt ("Heppt"), Mr. Kirk's former lawyer against whom this malpractice action has been brought. Heppt, pro se, has cross-moved for a protective order and sanctions. For the reasons set forth below, the motion of the Kirks is granted in part and denied in part and the cross-motion is denied.

Interrogatories and Document Requests were served by the Kirks on June 16, 2006. Responses to certain interrogatories were served on August 21, 2006, and a response, "No information will be provided in response to this improper interrogatory," was made with respect to others.

Answers will be made with respect to Interrogatories 8 and 35. Document Request No. 4 will be complied with. The malpractice insurance policy will be provided. The ordered responses and document production will be provided within 14 days or such other period as the parties may agree upon or the Court may order for good cause shown. The remaining motions of the Kirks are denied at this time.

It is so ordered.
