An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about August 10, 2023,
And plaintiffs-appellants having moved for a mandatory preliminary injunction requiring defendants-respondents, pending hearing and determination of the appeal, to make disbursements with respect to certain properties in accordance with a loan agreement for the properties entered into and serviced by defendants, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied; the interim relief granted by order of a Justice of this Court, entered on August 31, 2023, is hereby vacated.
