Hearing Granted June 15, 1944.

Appeal from Superior Court, City and County of San Francisco; Maurice T. Dooling, Jr., Judge.

Action by Wesley King against Frank C. Mortimer, Building and Loan Commissioner of the State of California, substituted in the place and stead of Pacific States Savings & Loan Company, to recover the amount of original savings deposits, less what they were sold for to the Pacific States Savings & Loan Company. From a judgment for defendant, plaintiff appeals.

Affirmed.
