Keyes v. General Motors Corp.

Supreme Court of Michigan
Aug 30, 1996
453 Mich. 872 (Mich. 1996)

Opinion

No. 105041.

August 30, 1996.

Summary Dispositions August 30, 1996:

In lieu of granting leave to appeal, that portion of the Worker's Compensation Appellate Commission opinion denying medical expenses other than those incurred by treatment with Dr. Velarde is vacated. MCR 7.302(F)(1). Contrary to the statement by the commission, the magistrate accepted the stipulation that plaintiff received personal injuries. The magistrate's findings relied on by the commission addressed the lack of continuing disability, not the lack of a work-related injury. The case is remanded to the Worker's Compensation Appellate Commission for further consideration of plaintiff's claim for medical benefits. Jurisdiction is not retained.

Court of Appeals No. 188410.
