This case is calendared for trial at the Trial Session of the Court scheduled to commence on April 4, 2022, for cases where Denver, Colorado is the place of Trial.

Petitioner Kyle Alan Kettinger informally advised the Court that he is currently deployed overseas and working with Respondent's Independent Office of Appeals regarding this case. Mr. Kettinger requested the case be delayed to a later date. Counsel for Respondent likewise informally advised the Court that as the Appeals Officer is still considering this case, therefore this case should be returned to the general docket. Under Rule 133 of the Tax Court's Rules of Practice and Procedure, the Court may continue a case at its own initiative.

After due consideration, and for cause, it is

ORDERED that this case is stricken for trial from the April 4, 2022, Denver, Colorado trial calendar and this case is continued generally.
