Respondent-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Niagara County, entered in the office of the Clerk of said Court on December 22, 2015,
Now, upon reading and filing the affidavit of Elizabeth Ciambrone, Esq., sworn to September 19, 2017, the notice of motion with proof of service thereof, and the affidavit of DesirÉ E., sworn to September 22, 2017, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on condition that the appeal is perfected on or before December 4, 2017, and
It is further ORDERED upon the Court's own motion, that Charles J. Greenberg, Esq., 3840 East Robinson Road, Suite 318, Amherst, New York 14228-2001, is hereby substituted as counsel to conduct the above-entitled appeal in place and stead of Elizabeth Ciambrone, Esq., and said appeal may be prosecuted upon one stipulated or settled record and ten copies of appellant's brief reproduced pursuant to CPLR 5529; and
It is further ORDERED that the Clerk of the Family Court, Niagara County is hereby directed to provide Charles J. Greenberg, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based.
