MEMORANDUM OPINION


Before the Court is appellant's December 6, 2010 motion to dismiss the appeal because the parties have settled. We grant the motion and, based on the parties' agreement, we dismiss the appeal, set aside without regard to the merits the trial court's order granting the plea to jurisdiction, and remand to the trial court for rendition of judgment as agreed upon by the parties. See Tex. R. App. P. 42.1(a)(2).
