[Modification of opinion (16 Cal.App.5th 841, ___ Cal.Rptr.3d ___), upon denial of rehearing.]

THE COURT. — The petition for rehearing filed by plaintiffs and respondents on November 14, 2017, is denied. The opinion filed in this matter on October 31, 2017, is modified as follows:

1. On page 29 the disposition [16 Cal.App.5th 860, advance report, first full par.] is modified to read as follows:

"If Kennedy does not seek to reinstate the remaining causes of action within 30 days of the issuance of the remittitur, the case will be final and the stay issued by this court on May 26, 2016, is ordered lifted."

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
