Kelly v. Hinrichs

Appellate Division of the Supreme Court of New York, Second Department
Jul 1, 1917
179 App. Div. 936 (N.Y. App. Div. 1917)

Opinion

July, 1917.

Judgment of the County Court of Kings county reversed and new trial ordered, costs to abide the event, upon the ground that Mrs. Parks was presumptively the agent of her husband to deliver the property to Bedell, and, therefore, there is no presumption of conversion by her, and the Statute of Limitations was not a bar to this action. Jenks, P.J., Thomas, Stapleton, Mills and Rich, JJ., concurred.
