MEMORANDUM OPINION


On September 30, 2008, appellants Melvin Kellough, Lorandon Byrd, Monte Byrd, and Charlotte Chapman, Individually and as Representative of the Estate of Dora Kellough filed a notice of appeal in this case. On October 30, 2008, we notified appellants that the $175 filing fee was due and that if appellants failed to pay the fee within ten days, the appeal would be dismissed. To date, appellants have not paid the filing fee or otherwise communicated with the Court regarding this appeal.

Accordingly, we DISMISS this appeal. See Tex. R. App. P. 5, 42.3(c).
