On August 24, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. In the motion, respondent states that petitioner died on April 3, 2023, and petitioner's legal name was Kay Simpler Keener.
Upon due consideration, it is
ORDERED that the caption of this case is amended to read "Kay Simpler Keener, Deceased, Petitioner v. Commissioner of Internal Revenue, Respondent".
