Opinion

No. 05-05-00380-CV

Opinion Filed August 3, 2005.

On Appeal from the 416th Judicial District Court, Collin County, Texas, Trial Court Cause No. 416-51573-03.

Dismiss.

Before Justices O'NEILL, RICHTER, and FRANCIS.

MEMORANDUM OPINION

The Court has before it appellee's July 7, 2005 motion to dismiss for want of prosecution. A review of this case shows appellant did not pay for the clerk's record or reporter's record or make arrangements to pay for the clerk's record or reporter's record. On July 7, 2005, appellee filed a motion to dismiss for want of prosecution. In a letter dated July 19, 2005, we informed appellant that both the clerk and court reporter had written the Court, stating that appellant had not requested the records, paid for the records, or made arrangements to pay for the records. We informed appellant that the case could not proceed without, at a minimum, the clerk's record. We instructed appellant to provide the Court, no later than July 27, 2005, written verification that he had paid or made arrangements to pay for the clerk's record, and if appropriate, the reporter's record. We stated that the failure to do so would result in this case being dismissed for want of prosecution without further notice to appellant. To date, appellant has not responded.

Accordingly, we GRANT appellee's July 7, 2005 motion. We DISMISS this case for want of prosecution. See Tex.R.App.P. 42.3(b).
