DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Dutchess County, dated December 31, 2018, which was dismissed by decision and order on motion of this Court dated May 24, 2021, for failure to comply with decisions and orders on motion of this Court dated October 16, 2020, and December 18, 2020, respectively. Motion by the appellants, inter alia, in effect, to recall and vacate so much of the decision and order on motion of this Court dated May 24, 2021, as dismissed the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to recall and vacate so much of the decision and order on motion of this Court dated May 24, 2021, as dismissed the appeal is denied; and it is further, ORDERED that the motion is otherwise denied as academic.
