The judgment is vacated insofar as it dismisses Beta Industries, Inc.'s, claims under counts five and six of the complaint and orders that those claims be submitted to FINRA arbitration, and the case is remanded to the Superior Court for further proceedings consistent with the memorandum and order of the Appeals Court. The judgment is otherwise affirmed.
