This case is currently set for trial at the Court's October 10, 2023, Birmingham, Alabama trial session. On August 28, 2023, petitioner filed a Motion for Continuance. Petitioner served a subpoena on CT Corporation on July 10, 2023, and requests time to enable CT Corporation to respond. Respondent does not object. The Court intends to grant petitioner's motion after hearing a report on the status of the subpoena. Upon due consideration and for cause, it is hereby

ORDERED that petitioner's Motion for Continuance, filed August 28, 2023, is set for hearing at the Court's October 10, 2023, Birmingham, Alabama trial session, scheduled to commence at 10:00 am, at the U.S. Circuit Court Jefferson County Courthouse, 717 Richard Arrington, Jr., Blvd., North Birmingham, Alabama 35203, at which any third-party subpoenas may be returnable. ORDERED that the parties may, on or before the call of this case from the calendar, file status reports regarding the subpoena served on CT Corporation on July 10, 2023.
