ORDER


On February 24, 2010, Defendant filed a motion to dismiss Plaintiff's Complaint. (Doc. 7.) On August 12, 2010, the Court granted leave for Plaintiff to file an amended complaint, Plaintiff did so, and the Clerk correctly terminated Defendant's motion to dismiss as moot. (Docs. 26, 27.) Defendant thereafter filed a document captioned as a supplemental memorandum supporting its previously-filed motion to dismiss. (Doc. 28.) This Court construes Defendant's memorandum as a renewed motion to dismiss and hereby ORDERS that Plaintiff may file a response to such motion within 21 days after this Order, and Defendant may file a reply within 14 days after Plaintiff's response.

IT IS SO ORDERED.
