District Court of Appeal of Florida, Third District
Feb 28, 2007
950 So. 2d 487 (Fla. Dist. Ct. App. 2007)

Opinion

No. 3D06-1428.

February 28, 2007.

An Appeal from the Circuit Court for Miami-Dade County, Orlando Prescott, Judge.

Bennett H. Brummer, Public Defender, and Gwendolyn Powell Braswell, Assistant Public Defender, for appellant.

Bill McCollum, Attorney General, and William J. Selinger, Assistant Attorney General, for appellee.

Before FLETCHER, SHEPHERD, and ROTHENBERG, JJ.

P.R., a juvenile, seeks to reverse an adjudication of delinquency and probation for trespass. We reverse. The State failed to present sufficient evidence that P.R. committed trespass or any conduct that could support a finding of delinquency. We therefore reverse P.R.'s adjudication of delinquency and remand with instructions to dismiss the case and discharge him.

Reversed and remanded with instructions.
