Appeal dismissed, without costs, by the Court of Appeals sua sponte upon the ground that the Appellate Division order granting a new trial did not "necessarily affect" the final judgment as required by CPLR 5601 (subd [d]) (Martin v Alabama 84 Truck Rental, 33 N.Y.2d 685 [and cases cited therein]; Cohen and Karger, Powers of the New York Court of Appeals, § 79, p 344).
