Following review of the petition for writ of habeas corpus and the response and reply thereto, it is ordered that said petition is hereby denied.

Upon consideration, appellee's motion for an order to the clerk of the circuit court to retransmit the record on appeal of Case No. 3D10–1687 is hereby denied as moot.
